Business Services

Unemployment Insurance claims are a reality of doing business. Many claims are legitimate, while others should be contested. Larger employers do so regularly, while it’s an infrequent occurrence for smaller employers.  Either way, contested claims are disruptive and can be costly. The maximum amount of regular state UI benefits a former employee can receive in Kentucky is now close to $14,800. Unless an organization is a non-profit “reimbursing employer,” it will likely pay this back to the state through UI taxes, generally in a greater than 1-to-1 ratio.

Kentucky law now requires employers (except for those not organized as a business entity, such as “sole proprietorships”) be represented by an attorney in Kentucky Unemployment Insurance hearings. Because UI has its own unique rules, procedures, and body of law, it is important to be represented by someone with experience. Employers’ in-house counsel may lack experience in UI law to get the best results, and most outside counsel focus only a small fraction of their practice on UI, and hourly fees can be high.

Maxson Firm, PLLC is focused exclusively on representing companies and individuals through the UI hearing process, from initial claim to final appeal at the Kentucky Unemployment Insurance Commission. We also represent our business clients throughout the court system.  Drawing on years of experience as in-house counsel for the UI program, we have an unsurpassed understanding of the best ways to represent Kentucky companies in UI matters. Our aim is not only to prevail for your company at the hearing, but also to properly build an evidentiary record and preserve objections there, that can ensure success on subsequent review. We have handled hundreds of UI cases from the administrative stage to the Kentucky Supreme Court, and we have many published UI opinions (including UI corporate tax). We offer comprehensive UI services to corporate clients, from handling individual cases on an hourly basis, to being on retainer to handle all your company’s UI matters, including being on-call to deal with issues as they arise, and providing UI best practice training to your team. Our considerable experience in UI allows us to manage cases efficiently and in a cost-effective way.

Our office is comfortable for any staff that visit for hearings, or they testify from the job site. Contact us today to discuss your company’s unique needs and to see what options we can offer to meet them.

unemployment benefits:

If you believe your former employee should not receive UI benefits, contact us to discuss how we can help mitigate your company’s exposure to charges for the claim.  We also offer corporate clients retainer packages that allow you to lock-in representation at discounted rates for all your contested UI claims, effectively allowing you to outsource your contested UI claims program, freeing up your staff to focus on what they’re good at, while we bring our considerable experience in UI to bear for you.

unemployment insurance corporate tax:

We have a significant experience in Unemployment Insurance corporate tax cases, many involving hundreds of thousands of dollars in back contributions, as well prospective changes in contribution rates moving forward.  We can represent your company in its Unemployment Insurance tax hearing.  These cases are usually long and complex, and can be costly to fight, but when there is a high amount in alleged back-due contributions and penalties, as well as prospective rate changes that will cost even more moving forward, fighting these tax determinations is frequently a good idea.  Call us to discuss your company's UI tax case early in the process.
